Final Rule Alert: TSCA Inventory Reset Reporting Requirement
In order to determine which of the roughly 85,000 chemicals on the TSCA Inventory are still “active” in commerce, US EPA today promulgated a Final Rule to require chemical facilities to report on chemicals manufactured or imported over a ten-year period between June 21, 2006 and June 21, 2016.7/21/2017

US EPA last week posted two Final Rules to the Federal Register that describe how the Agency will carry out its responsibilities for prioritizing and evaluating chemical substances as required under the Toxic Substances Control Act (TSCA), as amended by the Frank R. US EPA has announced the availability of documents that lay out the scope of the risk evaluations EPA will perform on the first 10 chemicals identified for evaluation under TSCA, as revised by the Frank R. Lautenberg Chemical Safety for the 21st Century Act (“The Lautenberg Law”).6/23/2017
EPA Finalizes New Active-Inactive TSCA Reporting Requirement
Under the new Final Rule, EPA will require chemical manufacturers and importers to submit a “retrospective electronic notification” for all chemicals manufactured or imported over a ten-year period—from June 21, 2006 to June 21, 2016.4/3/2017

In an executive order issued on January 20, the President of the US directed Federal agencies to delay the effective date of new regulations for sixty days. Sixty days later, US EPA has elected to further delay the implementation date for certain new rules.3/13/2017
