Why Did Delaware Update the Hazardous Waste Regulations?
Like most states, Delaware is authorized to run its own RCRA hazardous waste program. To stay authorized, states must maintain regulations that are at least as stringent as the Federal requirements.
EPA’s 2016 Generator Improvements Rule overhauled the Federal hazardous waste regulations, adding new, more-stringent requirements for container labeling, contingency planning, notification and re-notification, recordkeeping, and more. The Rule also re-organized the generator regulations in 40 CFR Part 262 and added some new reliefs, including an exception for episodic events (e.g. spills, lab clean outs) that generate hazardous waste.
Delaware’s state hazardous waste regulations are found in Title 7 of the DE Administrative Code, Part 1302.
Not First, Not Last
The First State was not first this time. Delaware becomes the thirty-third state to adopt the Generator Improvements Rule.
