TSCA Inventory Update: 40,655 Chemicals Active in US Market

The Frank R. Lautenberg Chemical Safety for the 21st Century Act (“the Lautenberg law”) amended TSCA to require EPA to evaluate the risks posed by all of the roughly 85,000 chemicals on the TSCA inventory. The law also required EPA to determine which chemicals on the inventory are active in commerce and which are inactive.

To collect the chemical manufacturing and import data needed to make the “active/inactive” determination, EPA promulgated a Final Rule in 2017 to require chemical facilities to submit a one-time report on all chemicals manufactured or imported over a ten-year period (June 21, 2006 to June 21, 2016).

February 2019 TSCA Inventory

The February 2019 update to the TSCA inventory shows that 86,228 total chemicals make up the current TSCA inventory. Of those, 40,655 are active in commerce (47%). The 40,655 includes more than 7,500 chemicals with identities protected as confidential business information.

The February 2019 TSCA chemical inventory is now available at EPA’s website. EPA updates the TSCA inventory about twice per year.

Manufacture/Import of “Inactive” Chemicals Under TSCA

The new active/inactive designations add a new consideration for TSCA compliance. Now, to manufacture or import a chemical, the manufacturer/importer must first check to see if the chemical is among the 40,655 designed as “active.”

If the chemical is designated as “inactive,” the facility must first submit a Notice of Activity (NOA) Form B to notify EPA of plans to reintroduce a chemical substance into commerce.
