RCRA Generator Improvements: EPA OK's Online Hazardous Waste Training
Among the updates that will impact facilities in EPA's RCRA Generator Improvements Final Rule, EPA added clarification to key parts of the regulations. One such clarification is the addition of online training (i.e., computer-based training (CBT) or electronic training) as an acceptable method for training hazardous waste personnel.11/11/2016
FMCSA Safety Advisory: Cargo Tank Motor Vehicles
On November 10, 2016, the Federal Motor Carrier Safety Administration issued a Safety Advisory to notify owners and operators of DOT 407 and DOT 412 cargo tank motor vehicles (CTMVs) manufactured by a company called Keith Huber Incorporated.11/11/2016
PHMSA Issues Guidance for Shipping Organic Peroxides, Self-Reactive Materials
Earlier this year, the US DOT Pipeline and Hazardous Materials Safety Administration (PHMSA) finalized a rule to remove the Packing Group II (PG II) designation for organic peroxides and self-reactive substances. The change was among many “miscellaneous” hazmat updates made in a Final Rule posted to the Federal Register on June 2, 2016. The new rule has been in effect since July 5.11/8/2016

Pre- EPA: US Environmental Laws Before 1970
The founding of the US Environmental Protection Agency (EPA) in 1970 by President Richard Nixon kicked off an explosion of environmental protection laws issued by Congress—like the Clean Air Act in the 1970s and the Comprehensive Environmental Response, Compensation, and Liability Act (CERCLA), also known as Superfund, in the 1980s.

EPA Announces First 5 Fast-Track Chemicals
Under the recently passed Frank R. Lautenberg Chemical Safety for the 21st Century Act, EPA will test and review the “legacy chemicals” and evaluate them for potential safety risks. Earlier this month, EPA named the first five of these chemicals to receive expedited action.11/1/2016
OSHA's Narrowed PSM Retail Exemption Now On Hold
In a regulatory interpretation issued July 22, 2015, OSHA narrowed the exemption from its Process Safety Management (PSM) Standard for retail facilities. Before this memo was issued, OSHA’s PSM “retail exemption” applied to facilities that “generate more than 50% of their income from direct sales of chemicals to end users.”Find a Post
